Here Comes May 4th
Last night I went to the movies. It was a Hollywood flick based mainly on a clever cinematic device. The same 23 minutes during a terrorist attack on the U.S. President is replayed four or five times (I lost count) from different perspectives.Next weekend will bring the Bolivian version of this dramatic device, but live instead of in cinemascope. Please be patient, I'll get to the mataphor eventually.
On Sunday May 4th an event will unfold here that will bring in reporters worldwide. This kind of attention over the years generally only comes to Bolivia when either: a) the government is going to fall, or b) people are going to start trying to kill one another over politics. In this case it will be the vote by the department of Santa Cruz on whether to approve “statutes of autonomy.” Some visiting press smell the possibility of one or both.
The Vote that Is and the Vote that Isn’t
The May 4th vote in Santa Cruz is a big deal in Bolivia. Let’s not lose site of that. In the current three ring circus of Bolivian politics, regional autonomy is in the center ring.
The new constitution produced by a year-long Constituent Assembly and backed by President Morales, was supposed to be the center ring next Sunday. But that vote got knocked off schedule formally because national election officials said the voting process didn’t meet all the legal requirements. But I think the real reason that Morales and MAS didn’t press forward had more to do with something they smelled, the real possibility of getting defeated.
Now, the Santa Cruz autonomy vote was officially given the same procedural thumbs down as the Constitution referendum, by the same officials at the same time. But, in contrast to Morales and MAS, Santa Cruz leaders clearly smell a whopping victory and, well, those are circumstances under which process and constitutionality are often set aside as less urgent by those doing the smelling.
The growing global interest in the autonomy vote next Sunday seems to revolve around two basic questions:
1. What does the vote really mean?
There are basically two main interpretations, both eager to make their case in rhetorical extremes.
The international left view is summed up by a recent letter on the subject, signed by 200 prominent left names from a variety of countries, including, from the U.S., Noam Chomsky and Ramsey Clark:
The subversive and unconstitutional actions of the oligarchic groups to try to divide the Bolivian nation reflect the racist and elitist minds of these sectors and constitute a very dangerous precedent not only for the country's integrity, but for other countries in our region.
[Note to whomever wrote this, in case you are reading: This is the kind of writing from left intellectuals that no one else really understands. FYI.]
Then there are the Santa Cruz civic leaders sponsoring the vote. They have proclaimed the vote, in essence: A democratic bulwark against Evo Morales’ Rasputin-like efforts to join Bolivia surgically to Cuba and Venezuela in a march toward left-wing authoritarianism. What do you say readers – does that about capture it?
Santa Cruz’s calming and mellow departmental governor, Ruben Costas threw some new logs onto the political fire this week by declaring that passage of the autonomy statutes would usher in a “second republic”, enflaming even more the charges of a secessionist plot. “Second Republic” to some sounds like “Third Reich” to others.
By the way, in case you missed it, according to the current round of conspiracy theories that secessionist plot is being handcrafted by the U.S. Ambassador here, who it seems also single-handedly engineered the same fete in Kosovo beforehand. This, of course, is despite ample evidence that the current Ambassador is little able to manage his own Embassy with much skill, much less a clandestine political conspiracy. But perhaps incompetence is just the political cover dejour.
Okay, do we all get the picture now? In summary:
1. Santa Cruz is going to vote.
2. The autonomy movement there was instigated by the region’s wealthy elite, with a good deal of economic self-interest and racism as fuel.
3. However, long ago that movement and the anti-Evo sentiment driving it also won the support of a lot of people who aren’t rich or white or oligarchs. This is – alternatively depending on your point of view – the product of political brainwashing or skilled political organizing. Take your pick.
4. Autonomy will win by a lot.
5. Then no one really knows what happens next.
On the two substantive issues that drive the autonomy issue – land reform and gas and oil revenue – the region and the Morales government seem to cancel each other out.
On land, Santa Cruz is one of the areas of Bolivia that land reform in the 1950s never really reached. I don’t see how Evo does much of anything there on land without sending in the Army to enforce it. And that is about as likely as me becoming one of Las Magnificas (though it does remain a secret dream). The episode last year of Morales’ quick (and wise) withdrawal of troops from the Santa Cruz airport is pretty good evidence of the government’s thinking on that topic.
On Santa Cruz’s desire for a bigger slice of gas and oil revenue, the situation is reversed and it is Morales who holds the upper hand. Bolivia’s big petroleum buyers are the governments of Argentina and Brazil, both currently left and sympathetic to Morales. The payments go to La Paz first, not the region. And don’t look for any sudden side deals from either country with the Newly Independent Republic of Santa Cruz.
Which takes us to the big question on people’s minds here…
2. Will there be violence?
In all kinds of political and social circles here one hears in ominous whispered tones the words, civil war. No question, the situation is delicate and dangerous. But as others wiser than I in the ways of Bolivia have pointed out, don’t look for rival armies to march on one another, or violence directly led by either faction. It is a long way from the dusty roads of Achacachi (where this past week I saw pro-constitution messages splashed in paint across the plentiful rocks) to the covered patio of Alexander’s Coffee in Santa Cruz. Morales has called for indigenous groups to suspend previous plans to march to the region the day of the vote.
The real danger of violence – and it is real – is from unexpected explosions where rival sides will find themselves in physical proximity to one another. Think the streets of Cochabamba, January 11, 2007. This includes, for example, the impoverished island of Plan 3000 near the city and indigenous areas of the department where community members would like as much autonomy from Costas and Company as Costas and Company want from Evo.
About that Cinematic Premise I Began With
All of which brings me back to watching the same 23 minutes over and over again from different vantage points.
Next Sunday, May 4th, the eyes of those who tune in via the “oligarchs vs. left authoritarians” channel will be watching the autonomy vote. Meanwhile on opposite sides of the Cochabamba Valley, Sunday will be marked in other, vastly different ways.
At the Fairgrounds the annual Expo will be wrapping to a close, ending a week of thousands braving the sun to see new cars, test samples of dried fruit, vomit up some of that dried fruit on the carnival rides, and celebrate Bolivian entrepreneurship in rare and exotic forms.
On my side of the Valley, here in Tiquipaya, we will have the annual chicha festival, and people in lesser numbers will also brave sun, but in the name of getting somewhere between tipsy to plastered on fermented corn.
So, I leave it to my readers to determine for themselves which is the “real Bolivia” that will be on display here May 4th. Will it be the people who march to suspect polls in Santa Cruz demanding a statutory divorce from La Paz? Will it be the indigenous peoples and left intellectuals warning that the vote is a racist plot? Will it be the people gawking at the latest cell phone models at the Expo? Or will it be my neighbors partaking in the best that fermented corn has to offer?
Or is Bolivia all of those things simultaneously, and desperately in need of a will and a way to hold such disparate pieces together?

While I agree with much of the analysis here ... please, don't confuse AUTONOMY with SECESSION. This is not the US in the 1860s. A better comparison would be Spain in the 1980s (when Catalonia and other regions won autonomy). Or perhaps, the indigenous movements themselves, which also want autonomy (and should have a right to vote on that, too!). Bolivia may not become a "Second Republic" (whatever that means). But perhaps the days of the myth of the homogenous nation-state are ending.

La Coordinadora is hoping to bring out 100,000+ people out on the street in Cochabamba to show support for national unity and against autonomy. Therefore, not everyone will be just knocking back chicha in Cochabmba.
While McCentellas is probably right about autonomy vs. succession, his constant equation of indigenous autonomy and media luna autonomy is erroneous and without historical context. Even if you do not buy orginarios arguments, since 1952 the eastern lowlands have benefited tremendously from a centralized government. Now that they are wealthy they do not want to share. That might be par for the course for human behavior; it does not make it just or fair. Simply stating that Evo supports autonomy for Indians therefore Santa Cruz deserves it too is simplistic and unfair comparision
Anticipating some irrationaly rant from Bolivia Libre about MASSISTA, at least the highlands have done away with indentured servitude.
If Santa Cruz wants autonomy, let them have it, along with the creation of tenth department, as some NGOs here are promoting, located in the oil-gas rich region near the border with Paraguay to be dubbed Heroes del Chaco, and the lands therein dispursed to the Guaranis.

Also, you forget to mention the importance of the different departments for the Bolivian GDP, the natural gas reserves in Tarija, etc, etc...

Why did Costas fly to Paris the week of the massacre at Huanuni, Jim?He said he was flying to Paris to talk about autonomy then flew homw after 3 or 4 days.There wasn't much TV coverage or any conclusions from it that I saw voiced publicly.
MAS Senator Guido Guardia, one of the senior members of the Bolivian government then went on TV a couple of days later to say the Bolivian government had basically tracked him not to Paris, but the US.

When you mention the fuel that moves the autonomic movement you are right, the unbelievable amount of racism coming from the neo indigenous fascism of the maSSist side has propelled many, rich and poor, and Santa Cruz mostly agro industrial elite to seek a safe haven within the country away from the Morales tyranny. It is funny how elitist you are, thinking that people are naïve dummies that can be mass brainwashed or mass skillfully fool by they likes of you.
The common people in Santa Cruz, and many other around the country, are seeing in the autonomic movement the same thing the middle class people that catapulted the maSSists to power so in Evo Morales; hope for better days. Regarding land, have you ever questioned yourself why the agrarian revolution didn’t reach Santa Cruz, Beni and Pando in the 1950’s? Does your economics’ background allow you to understand things like rich and poor soil? Livestock pressure on land? Do you understand that in the 1950’s extensive agriculture in Bolivia was inexistent as well as soy was a rare plant? Have you read what the Morales project of constitution say about who is allowed to own agricultural, or grassland? Isn’t it based on the color of the skin of the Bolivian citizen that want’s to work in agriculture or with livestock? Go to the Agriculture Faculty at San Simon in Cochabamba Jim, and then tell me what all those light skinned students are going to be doing in a maSSist future.

I agree with 90 percent of what you write, and I appreciate hearing your analysis of Evo's side of things because you explain his position much better than anyone in his government seems to be able to, but there is one area where you have blinders on.
Why does the autonomy movement have to be fueled by racism? Why can't someone who has nothing against indigenous peoples, and perhaps even wants to see a Bolivia with more social justice, also want to keep more control over government spending closer to home? Many Cambas who are not part of the oligarchy believe that their city doesn't recieve its share of public money for schools, roads, police even though most of the most of the tax money comes from their region.
That is a piece I would love to see you do. How much money is spent on schools per capita in La Paz vs in Santa Cruz? (schools in the "prosperous lowlands" aren't exacly luxurious. I visited a public school in Santa Cruz to donate chalk boards and the teachers said what they really needed was a bathroom because the kids currently were squatting outside.) What about police, how many per capita here and there? Is it true that Santa Cruz is neglected? Why does Santa Cruz look like such a dump while Chochabamba is clean? Why is the road between Santa Cruz and Semaipata arguably the worst maintained in the country?
Honestly, is there any truth to the Camba claim that La Paz is biased against them and that they are not getting their fair share of tax money? What is racist about wanting to hire your own police force locally?

Only Santa Cruz Department is voting on autonomy on May 4. That has 26.20% of the country's population and 33.74% of the country's land area. I've seen polls that say that support for autonomy is around 70%.
The five "Media Luna" departments (Santa Cruz, Beni, Pando, Tarija and Chuquisaca) comprise 40.18% of the country's population, and 67.11% of the country's land area.

camba boys use the word 'colla' as an insult from an early age. regardless of the fact that there are very legitimate autonomy arguments, the majority of the people making those arguments are racist and to one extent or another, their feelings and arguments are fueled by racism.
To Bolivia Libre, please provide concrete exmaples of indigenous-highland racism against Cruceños if you are capable rather than polemic rants. Nice that even the conservative television stations reported last night that thousands of paphlets were distruibuted in Santa Cruz calling for ethnic cleansing, and the killing of Collas, along with eugenic like methods to calculates ture "cambaness," i.e. madre camba + padre colla = camba. desarrollo legislativo, potestad reglamentaria y función ejecutiva
sobre:
1. Desarrollo integral de los pueblos indígenas oriundos del
Departamento 2. Desarrollo integral de las comunidades campesinas
del Departamento. 3. Régimen de protección de personas y bienes, y
mantenimiento del orden público.
* Comentario: Si se trata de protección a los indígenas los
pueblos del Oriente de Bolivia se han caracterizado por la
explotación a ellos porque existe el feudo hasta ahora... y los
indígenas trabajan toda su vida y aún así acaban debiendo a los
hacendados... si este estatuto los “protegerá” podemos esperar
que su situación de explotación no cambie o que empeore ? Sí.
Un ejemplo es el intento de secuestro a Muruchiva de la Gran
Asamblea del Pueblo Guaraní APG, Wilson Changaray y al Sr
Viceministro de Tierras Alejandro Almaraz por parte de los
Ganaderos en la Provincia Cordillera, con el fin de impedir el
proceso de saneamiento de Tierras, para liberar a los hermanos
cautivos del Pueblo Guaraní.
4. Asuntos de género y generacionales. 5. Acuerdos internacionales
de interés específico para el Departamento.
* Comentario: los acuerdos internacionales no se hacen más que
directamente con el país ... este artículo expone la real
intención de dividir Bolivia... obviamente el delito es de
sedición o traición a la Patria.
8. Régimen laboral y de seguridad social.
Comentario: seguro que la situación de la gente común, los
trabajadores y campesinos empeorará, ya que los autores de los
estatutos autonómicos son los terratenientes, madereros,
empresarios, señores feudales y otros similares.
10. Medios de comunicación, con el fin de garantizar la libertad
de prensa.
* Comentario: seguro que no planean la libertad de prensa ya que
canales como Unitel (de propiedad de un latifundista cruceño que
tiene problemas con la justicia por arruinar la linea aérea
boliviana LAB) siempre apoyaron al expresidente Gonzalo Sanchez
de Lozada (otro prófugo de la justicia) y sus noticias siempre
son desde un ángulo que beneficie a los terratenientes
cruceños (ya que su dueño es uno de ellos) es más, en el
referéndum que hubo antes en Santa Cruz fue Unitel el que regaló
poleras de “viva la autonomia de Santa Cruz”.. entonces se puede
esperar que Unitel sea imparcial ? Nunca.
Es más hasta wikipedia dice de Unitel: Últimamente, este medio
de comunicación ha recibido críticas por parte del gobierno
central por estar informando de manera parcializada y de
desestabilizar al país, aunque no se ha probado nada aún. También
se ha caracterizado de ser el único medio nacional que apoya
abiertamente las autonomías departamentales y la separación de
Santa Cruz como autonomía.
11. Recursos naturales renovables, que no fueran de competencia
exclusiva del Departamento.
Comentario: planean meterse con los recursos naturales
renovables de los departamentos vecinos.
12. Recursos naturales no renovables.
* Comentario: planean talar más madera y desforestar porque así
se benefician los ganaderos, madereros, empresarios... pero no la
gente que trabaja como esclava en sus haciendas.

Artículo 8. Competencias de ejecución : El gobierno autonómico
ejecuta la legislación nacional en : Crédito, banca y seguros,
gestión del sector público económico estatal, seguridad social,
propiedad intelectual e industrial, sistema penitenciario,
realización de obras de interés nacional por la administración
autonómica, registro civil.
* Comentario: si el sistema laboral queda afectado acaso no la
seguridad social ? sí, esto es incongruente al igual que lo demás
porque todo quedaría afectado especialmente si dicen que se
aplicaría de preferencia sus normas departamentales. Indican que
aprobarán nuevos reglamentos para estas materias.

Artículo 10. Aplicación preferente del derecho autonómico.
I. Cuando la competencia del Gobierno Departamental Autónomo de
Santa Cruz consista en el desarrollo de la legislación básica
nacional, las leyes de desarrollo dictadas por el Asamblea
Departamental, siempre que no contradigan dicha legislación
básica, serán de aplicación preferente a cualesquiera otras leyes
de desarrollo. II. Asimismo, cuando la competencia del Gobierno
Departamental Autónomo de Santa Cruz consista en la reglamentación
de la legislación nacional para su ejecución, las disposiciones
reglamentarias dictadas por el Ejecutivo Departamental, siempre
que no contradigan dicha legislación, serán de aplicación
preferente a cualesquiera otras disposiciones reglamentarias.
Comentario: quiere este articulo dictar leyes para el país
entero o sólo es mala redacción .. lo que queda claro es que
quieren tener nuevas normativas penales y civiles, laborales, sin
rendir auditorias.

Artículo 11. Delegación y solicitud de competencias:I. El
Gobierno Departamental Autónomo de Santa Cruz podrá solicitar a
los órganos nacionales pertinentes, la delegación o transferencia
de la competencia exclusiva del Estado Nacional en una o más
materias, con la finalidad de cumplir mejor los fines de la
administración pública en beneficio de los ciudadanos. II. El
Estado Nacional podrá solicitar la competencia exclusiva del
Departamento en una o más materias, previa aprobación de la
Asamblea Legislativa Departamental, mediante Ley de Reforma del
Estatuto aprobada por dos tercios de sus miembros, con la
finalidad de cumplir mejor los fines del Estado Nacional y del
Departamento.
Comentario: quieren tener los beneficios y no las obligaciones

Artículo 13. Control de constitucionalidad del conflicto de
competencias:Los conflictos de competencias entre el Estado
Nacional y el Gobierno Departamental Autónomo de Santa Cruz, o
entre éste y los Gobiernos Municipales serán dirimidos a través
del control de constitucionalidad.
Comentario: qué es el control de constitucionalidad ? Ningún
abogado lo sabe. Pero si se refieren a la pirámide de Kelsen
significa que habiendo conflicto sus leyes se somenten a la
Constitución del país pues es la norma de normas, eso hasta un
estudiante lo sabe.

Artículo 15. Órganos del Gobierno Departamental:Los órganos del
Gobierno Departamental Autónomo de Santa Cruz son la Asamblea
Legislativa Departamental y el Ejecutivo Departamental, a través
de los cuales el Gobierno Departamental ejerce sus competencias,
de conformidad con el presente Estatuto.
* Comentario: realmente piensan crear sus leyes, es seguro que
para beneficio de los latifundista, madereros, ganaderos y otros
empresarios ... pero beneficiarán a los campesinos y gente
común considerando que los autores son de extrema derecha ?

Artículo 19. Requisitos para ser Asambleísta :Para ser Asambleísta
los ciudadanos deben cumplir con los siguientes requisitos
mínimos: Tener nacionalidad boliviana. No tener pliego de cargo o
sentencia condenatoria ejecutoriado. Otros requisitos establecidos
en la Ley Electoral del Departamento.
* Comentario: sin embargo el Art 3. dice que sólo los cruceños
pueden participar en asuntos departamentales y ser elegidos como
autoridades.

Artículo 20. Atribuciones: La Asamblea Legislativa Departamental
tiene las siguientes atribuciones: Legislar sobre todas las
materias de competencia exclusiva del Departamento Autónomo de
Santa Cruz, sobre las que les sean transferidas por el Estado
Nacional y sobre las que asuma en virtud del principio de
subsidiariedad, de acuerdo al presente Estatuto.Desarrollar la
legislación básica nacional en aquellas materias de competencia
compartida con el Estado Nacional.
* Comentario: cómo este departamento puede si quiera pretender
crear leyes que afecten a otros departamentos ? es totalmente
ilegal.

la realización de Referéndum Departamental, previa recolección de

El inciso r dice: Cada Asambleísta tiene legitimación activa para
interponer, ante la Corte Superior de Distrito del Departamento,
el recurso abstracto de ilegalidad contra las Leyes y Decretos
Departamentales, que contradigan el presente Estatuto.
Comentario: no se pueden presentar recursos en un tribunal
inferior como seria la “Corte Superior de Distrito del
Departamento”; esto pretende ignorar toda ley de Bolivia... Santa
Cruz estaría sin leyes! Sálvese quien pueda!!!

CAPÍTULO SEGUNDO. DEL EJECUTIVO DEPARTAMENTAL .Artículo 29.
Atribuciones. El Gobernador del Departamento Autónomo de Santa
Cruz tiene las siguientes atribuciones: Reglamentar, ejecutar y
hacer cumplir las Leyes departamentales, expidiendo los decretos y
órdenes convenientes. Presentar la cuenta general de los ingresos
y egresos de cada gestión financiera, acompañada de un Informe de
la Contraloría, a la Asamblea Legislativa Departamental.
* Comentario: presentarían su contraloría a sus instituciones ,
quién asegura la transparencia ahí ? Nadie porque nadie puede ser
juez y parte... al mismo tiempo.

Promover y suscribir acuerdos internacionales de interés
específico para el Departamento.
* Comentario: sólo los países pueden suscribir acuerdos
internacionales. Sus acuerdos serían nulos de pleno derecho

Artículo 30. Responsabilidad del Ejecutivo Departamental:El
Gobernador, el Vicegobernador y los Subgobernadores gozan de
inmunidad, que consiste en que sólo podrán ser enjuiciados por la
Corte Suprema de Justicia, a requerimiento del Fiscal del Distrito
de Santa Cruz, previa autorización de la Asamblea Legislativa
Departamental .
Artículo 32. Inviolabilidad de los derechos y libertades
fundamentales. Las inmunidades y prerrogativas señaladas para el
Gobernador, el Vicegobernador, los Subgobernadores y los
Asambleístas, no son aplicables cuando se trate de violaciones a
los derechos y libertades fundamentales de las personas, en cuyo
caso, serán juzgados por la jurisdicción de garantías
constitucionales.
* Comentario: si Santa Cruz piensa crear sus propias leyes , cómo
pueden someterse sus autoridades a la Corte Suprema de Justicia ?
Habría una doble legislación... y en todo caso su estatuto indica
que en caso de conflictos de competencia se daría prioridad a su
nueva legislación ... lo que crearía muchos conflictos de este
tipo... además si no habría fiscalización del Estado, cómo
podrían salir a la luz sus delitos ? No podrían y además habría
un conflicto contínuo de leyes. Por qué necesitan hacer esto ?
Para que no les quiten tierras.

Artículo 33. Vigencia del régimen de responsabilidad de la
administración pública nacional: Todas las personas que desempeñan
cargos remunerados en los órganos del Gobierno Departamental
Autónomo de Santa Cruz, incluidas las autoridades mencionadas en
los artículos anteriores, están sujetas a las disposiciones
legales generales del régimen de responsabilidad para la
administración pública boliviana.
Comentario: crea una confusión jurídica de la que nadie se
podrá escapar.

Artículo 99. Productividad con identidad en las Tierras
Comunitarias de Origen Es obligación del Gobierno Departamental
tomar medidas que fomenten la generación de actividades
productivas sostenibles en las Tierras Comunitarias de Origen
(TCO) de los pueblos indígenas oriundos del Departamento Autónomo
de Santa Cruz.
* Comentario: los empresarios ingresarán y harán uso para su
beneficio de las Tierras Comunitarias de Origen (TCO) de los
pueblos indígenas.

Artículo 104. Persecución y sanción del latifundio El latifundio,
entendido como grandes extensiones de tierras improductivas, no
está reconocido por el Gobierno Departamental Autónomo de Santa
Cruz, se lo persigue y sanciona por ser contrario al interés
colectivo y no cumplir ninguna función social ni económico-social.
* Comentario: los autores de este estatuto son grandes
latifundistas por lo que no pueden sancionar el latifundio.
El presidente del Comité Cívico Pro-Santa Cruz , Branco
Marinkovic , es un gran latifundista en santa Cruz y ahora tiene
problemas legales de sus tierras, ya que , como muchos otros
latifundistas en Bolivia, no tiene título de las mismas, no tiene
papeles que demuestren su propiedad .. porque no existen.. Y estos
son los motivos para impulsar una autonomía en Santa Cruz.

Artículo 105. Reagrupamiento, distribución y redistribución de
tierras .
El Gobierno Departamental, a través del Instituto Departamental de
Tierras (IDT), aplicará procesos de reagrupamiento, distribución y
redistribución de tierras para evitar la aparición de fenómenos de
minifundio improductivo, en los casos que corresponda, con la
autorización del Consejo Agrario Departamental (CAD), en
coordinación con los Gobiernos Municipales Autónomos.
* Comentario: este artículo pretende la redistribución de las
tierras para darles todas a los empresarios latifundistas... ya
que en realidad piensan condenar el minifundio para beneficio del
latifundio

Artículo 107. Instituto Departamental de Tierras (IDT) I. El
Instituto Departamental de Tierras es una institución
descentralizada del Ejecutivo Departamental, bajo la tuición del
Secretario Departamental que corresponda, y es responsable de la
ejecución del saneamiento de la propiedad agropecuaria,
regularización de derechos de propiedad de la tierra y aplicación
de las políticas de tenencia, dotación, adjudicación, distribución
y expropiación de tierras en el Departamento Autónomo de Santa
Cruz.
* Comentario: siendo los autores del estatuto los grandes
latifundistas no son ellos a los que expropiarán tierras sinó a
los pobres campesinos que aún las tienen y los pueblos indígenas!!

Artículo 108. Tierras fiscales dentro del Departamento. I. Las
tierras fiscales dentro del territorio departamental, que hayan
sido declaradas disponibles, serán dotadas, adjudicadas,
concesionadas, distribuidas y redistribuidas por el Ejecutivo
Departamental de Santa Cruz.
Comentario: siendo los autores del estatuto los grandes
latifundistas ellos serán los únicos beneficiados de las tierras
fiscales.

DE LOS SUELOS FORESTALES Y LOS BOSQUES .Artículo 110. Legislación
Forestal .La Asamblea Legislativa Departamental aprobará una Ley
Forestal que regulará el acceso y aprovechamiento sostenible de
los suelos forestales y bosques del Departamento Autónomo de Santa
Cruz, así como el sistema de cobro y distribución de patentes
forestales.
* Comentario: piensan dar los bosques a los madereros y a otros .

Artículo 131. Distribución de las regalías departamentales . I.
Las Regalías que recibe el Departamento por concepto de la
explotación de los recursos naturales renovables y no renovables,
se distribuirán de la siguiente manera: 50% a las provincias
productoras donde se originen las Regalías. 40% a las provincias
no productoras. 10% a los Pueblos Indígenas oriundos del
Departamento a ejecutarse en sus correspondientes Tierras
Comunitarias de Origen (TCO).
* Comentario: Los indígenas serán explotados nuevamente en sus
Tierras Comunitarias de Origen (TCO) pues sólo recibirán un 10%
de las regalías que generen.

Artículo 142. Competencia . En todo caso, la Corte Superior de
Distrito de Santa Cruz es competente en materia civil-comercial,
penal, laboral y de seguridad social, familiar y del menor,
tributaria, agraria, contencioso-administrativa y en las demás
materias que se establezcan en virtud del presente Estatuto.

Artículo 143. Última instancia autonómica, control de legalidad y
jurisprudencia autonómica departamental I. La Corte Superior de
Distrito de Santa Cruz es la última instancia jurisdiccional y
dicta Sentencias con autoridad de cosa juzgada en aquellos
procesos en que el derecho aplicable de manera preferente sea el
derecho autonómico cruceño, es decir, en aquellos procesos que
versen sobre las materias de competencia exclusiva del
Departamento, de acuerdo al presente Estatuto. II. La Corte
Superior de Distrito de Santa Cruz tiene competencia para conocer
en única instancia el recurso abstracto de ilegalidad contra las
Leyes y Decretos Departamentales que contradigan el presente
Estatuto de Autonomía.
* Comentario: De tal forma que no existe ninguna forma de abolir
este sistema una vez “legalizado”; aunque...esto sería si es que
se puede legalizar algo que nació a la vida con vicios de
nulidad.. porque todos sabemos que no se puede legalizar un acto
nulo porque ya nació muerto a la vida jurídica.

Artículo 161. Reconocimiento . De acuerdo al Convenio 169 de la
OIT y el Convenio de Naciones Unidas sobre Pueblos Indígenas, el
pueblo cruceño reconoce con orgullo su condición racial
mayoritariamente mestiza, y, en esa medida, su obligación de
conservar la cultura y promover el desarrollo integral y autónomo
de los cinco pueblos indígenas oriundos del departamento:
Chiquitano, Guaraní, Guarayo, Ayoreo y Mojeño, de conformidad a lo
establecido en este Estatuto.
Comentario: simple reconocimiento de los indígenas sin derecho
alguno a nada.

Artículo 168. Procedimiento de Reforma I. La iniciativa para la
reforma del Estatuto corresponde al Gobernador o a un tercio de
los miembros de la Asamblea Legislativa Departamental. II. La
reforma del Estatuto deberá ser aprobada por la Asamblea
Legislativa Departamental, mediante Ley de Reforma del Estatuto
aprobada por dos tercios de sus miembros, salvo que sólo tuviera
por objeto la ampliación de las competencias del Departamento, en
cuyo caso, la Ley de Reforma del Estatuto se aprobará por mayoría
absoluta. III. Si la iniciativa para la reforma del Estatuto no
obtuviera las mayorías previstas en el párrafo anterior para cada
caso, o no se lograran los requisitos exigidos para su aprobación,
no se podrá iniciar un nuevo procedimiento de reforma sobre el
mismo punto durante el mismo mandato de la Asamblea Legislativa
Departamental.
* Comentario: limita la posibilidad de reforma de la Asamblea
Legislativa Departamental. Limita la posibilidad de control del
poder una vez instalados

DISPOSICIONES TRANSITORIAS. Primera. Del proceso de transferencia
de competencias II. La transferencia de competencias será
obligatoriamente acompañada de los recursos económicos y
financieros establecidos en el Presupuesto General de la Nación
(PGN), vigente en ese momento, para la atención de estas
responsabilidades independientemente de la fuente de
financiamiento de los mismos.
Comentario: Por qué se imaginan que el Estado pagará el costo
de su “autonomía” que es más bien traición a la patria ?

III. Los inmuebles y demás bienes públicos de propiedad del Estado
Nacional, que sirven para el funcionamiento de la administración y
la ejecución de las competencias referidas en el presente
artículo, serán transferidos, a título gratuito, al Departamento
Autónomo de Santa Cruz.
Comentario: A título de qué el Estado bolivianao les donaría
inmuebles u otros bienes públicos ?

Segunda. Atribuciones transitorias del Consejo Departamental
Hasta que se conforme la Asamblea Legislativa Departamental,
mediante la elección por sufragio universal de sus integrantes, el
Consejo Departamental, de conformidad a la Resolución del Consejo
Departamental N° 137/2006 de 04 de diciembre de 2006, podrá asumir
las atribuciones y competencias establecidas en este Estatuto para
la Asamblea Legislativa Departamental.
Comentario: el El denominado Consejo Nacional Democrático
(Conalde) agrupa a los políticos, prefectos y cívicos (que manejan
a grupos de choque y violencia).

Sexta. Órgano de control de constitucionalidad. En caso de que la
conformación del órgano de control de constitucionalidad de
Bolivia llegue a realizarse en violación de los principios
constitucionales de independencia de poderes y de idoneidad y
especialidad de la función judicial, el Departamento Autónomo de
Santa Cruz no se someterá a su jurisdicción, hasta que cese dicha
violación.
Comentarios: el órgano de control de constitucionalidad de
Bolivia se refiere a la nueva Constitución Política del Estado de
la Asamblea Constituyente, y lo que dice este artículo es que
Santa Cruz espera que la Constitución del País se someta a su
estatuto, lo que es absurdo porque todos sabemos que primero está

It’s actually a much shorter and clearer way to say what the CPE Article 23 manages to stuff into 6 paragraphs without clearly protecting anyone. Read sub-paragraph III.:
Nadie podrá ser detenido, aprehendido o privado de su libertad, salvo en los casos y según las formas establecidas por la ley. La ejecución del mandamiento requerirá que éste emane de autoridad competente y que sea emitido por escrito.
In other words, no one can be arrested unless we pass a law that says so and how. But the arrest warrant has to come from some unnamed competent authority in writing. Somehow that wouldn’t give me a warm and fuzzy feeling. Of course neither one really comes close to the protection of the US Constitution’s 4th and 5th amendments.

I asked the question "why does the autonomy movement have to be fueled by racism?" and someone (it may have been you) said basically that there may be some legitimacy to the autonomy argument but that the people making the argument are racists.
I agree that people in Santa Cruz say things that are outrageous, but I think if you listenened you would hear things coming fom the highlanders about the lowlanders that are just as outrageous, and you hear anti- colla sentiments from the lower class, indigenous peoples of Santa Cruz as much as you do from the high class.
The truth is that there is a long history of the highlanders, first ignoring and neglecting, and then, when they realized the riches from the mines were chipping away and they finally decided to look east, invading and brutalizing the lowland people. The strong sense of regionalism is often expressed in ugly racist terms, but if you look at the history, I think the Cambas have been the victimized minority.. not the other way around. Have you ever read what the Ucurenos did to the University students down here? They brought those boys bodies into town with their intestines wrapped around their heads and... in one case with genitals and eyes removed. That is part of the collective memory down here. I think calling it clear cut hatred of whites for Indians is over-simplification. For a long time the highlands were way ahead of Santa Cruz developmentally. Santa Cruz was a back jungle country town with no paved streets or drinkable water when La Paz decided finally to build a decent road to Cochabamba... and even then the Cambas had to fight to keep the amount of the oil revenue that was leagally theirs (11%)
I mean, they aren't saints, but lets stop dismissing them as racists and start really looking at what they are saying, because the truth is, the highlanders hate the lowlanders too, it just isn't considered racism when people of color insult whiter people.

(ALAI AMLATINA).- Me encuentro en la Avenida Santos Dumont a la altura del tercer anillo de la ciudad de Santa Cruz. Desde el corazón mismo de esta tierra, desde esta región que se apresta a vivir un duro episodio de su historia, tengo el deber moral de denunciar a Bolivia y el mundo lo siguiente:
Santa Cruz en estos momentos es víctima de un acuerdo político, de un pacto de sangre de logias que controlan a la región con la estrategia del miedo. Logias que articulan un discurso, que en apariencia es cruceñista, pero que no hace más que esconder de la manera más aviesa oscuros intereses contra el pueblo y contra el gobierno democráticamente electo.
El ambiente social aquí en Santa Cruz es de temor e incertidumbre. Una parte de la población ha instalado un ambiente de fiesta, de alegría, con marchas, música carnavalera y baile de jóvenes y muchachas y niños. Otros sectores miran en silencio, con impotencia y mordiéndose la lengua lo que hacen los sectores acomodados, los cambas blancos que descienden de extranjeros.
La estrategia del miedo ha funcionado. Los sectores duros han logrado que la Unión Juvenil Cruceñista sea temida por una buena parte de la población. Otros sectores en cambio hicieron a un lado el miedo y toman las calles y las plazas para protestar y expresan su voz en canales, radios y periódicos alternativos, pero la cobertura de prensa para esas voces es tan reducida e insignificante que da la impresión de que en Santa Cruz hay una sola consigna, una sola mirada y una sola línea política.
Los medios de comunicación en Santa Cruz han tocado fondo en cuanto a credibilidad. Radios, canales y periódicos han establecido un cordón umbilical directo con el Comité Cívico Pro Santa Cruz y la prefectura.
Como nunca había ocurrido en la historia de la comunicación en los canales no hay cabida para las voces disidentes. Muchos conductores y periodistas dan por hecho que todos apoyan los estatutos autonómicos y que TODOS deben votar por el sí el domingo 4 de mayo, en la consideración de que los OTROS no cuentan y por tanto no son parte del TODO. La capacidad crítica de los periodistas de los grandes medios está en pausa y muchos de ellos ni siquiera ya guardan el decoro de disimular lo que hacen, porque en Santa Cruz el que no sigue el guión es fichado por los líderes de las logias y "se queda sin pega".
Quien enciende un televisor y pasa revista a los canales tradicionales, observa que solo hay un discurso de línea proautonomista y si algo se dice del gobierno es en clave de contrainformación, para señalar que de cualquier modo el gobierno ataca a Santa Cruz, "que el gobierno se agarró con Santa Cruz".
Las condiciones para ejercer el derecho a la libertad de expresión son tremendamente adversas y esta dictadura mediática solo tiene parangón con lo que vivimos con gobiernos dictatoriales.
La Corte Departamental Electoral tiene el más triste papel y al señor Parada no solo le dieron el triste papel de llamar a votar a la ciudadanía cruceña, sino que a través de spots dice que el referéndum de Santa Cruz está absolutamente apegado a la ley. "Con la ley en la mano" tienen la desfachatez de decirle al ciudadano cuando toda Bolivia y el mundo sabe que es un referéndum sin manto legal y absolutamente atentatorio al estado de derecho y por eso mismo con cariz de golpe de estado político dentro de un régimen democrático.
De darse la consulta autonómica, el evento habrá hecho meritos para ingresar a los Guiness record porque será la primera que se llevará a cabo una consulta, un plebiscito, sin previo debate, sin contraposición de ideas, con tanta mentira, discriminación y desprecio por el otro, es decir se sufragará en un clima absolutamente antidemocrático.

Bolivians have been keenly aware of the state of their multi-nationalities for many years and much has been written on the subject of the many nations who have not been able to be a homogenous state. However, the myth that there are no indigenous nations in the lowlands has only been attempted to be burst since the early 90s when the CIDOB and others marched to La Paz demanding a new constitution to include them. Has anyone noticed there are no upper class rich indigenous people in the lowlands? And yes, there are many white rich highlanders who have happily colluded with their counterparts in the east under the common understanding the whole camba-colla debate is for the lower echelons of society. I wish there will be no blood in the days to come but rather an opening to new dialogues that will force citizens to be more scrutinizing of facile arguments set forth as "ending the myth of the homogenous nation-state." What is at stake now is much more than are llamas or toucans a better representation of our national symbols, it is how can we be more inclusive of all nations in Bolivia and more important, how can we distribute the social-financial gains of our natural resources in order to build upon the human capital of our peopleS, yes with an "s"!

As far as economics go, that's precisely the question. The rub is that the current regime wants to impose, yes impose, a half-baked communist, indigenist economic system that has never worked, while becoming bosom buddies with Iran and Cuba. Crucenos, Tarijenos, Benianos, and Pandinos appear to reject such a system, looking for inspiration from the developed countries of the world, where there is political and economic freedom.
