Bolivian Referendumitus

Readers:

While I remain on the road (in Washington this week, meeting with my supervisors at the CIA) political events continue to spin forward in Bolivia.
Here is a report from Aldo Orellana and Lily Whitesell on one of those important events, the autonomy votes last Sunday in two Cochabamba departments.

Bolivian Referendumitus

On Sunday, June 1, the regional authorities of Pando and Beni brought their autonomy statute legislation, which they had approved in December 2007, to a public vote.

The results were not unexpected. According to the local press’ numbers from Sunday night, the yes vote won more than 80% of the vote in both regions. However, absenteeism, which the Morales government heralded as the best way to express disapproval of the vote, reached levels that gave autonomy supporters in the media luna reason to worry, above all in Pando. (The media luna is the group of four regions that voted in favor of autonomy in a 2006 Constituent Assembly referendum: Santa Cruz, Beni, Pando, and Tarija. The prefects, or regional governors, of these four regions are leaders in the opposition against President Morales.)

As the results came in, there was a moment in which the level of absenteeism in Pando came dangerously close to 50%. According to the regulations that govern Bolivia’s referendums, if less than 50% of the eligible population had voted, the referendum vote would have been declared invalid.

The initial reactions of the Morales government were given by the government minister Alfredo Rada, who told the La Paz press that, “the call for autonomy cannot continue to be damaged like this, with these illegal processes [referendum votes] that have no backing. Beyond the media’s attempts to create pyrrhic victories, they are simply going to end up hurting the autonomy cause, which is a legitimate one and which has public support.”

Unfortunately, there were allegations of election fraud in Pando and an attack on the headquarters of the small farmers’ union in Beni. The government accused the Santa Cruz Youth League (Union Juvenil Cruceñista) of being behind the attack.

The Referendums as a Measure of the Prefects’ Popularity

The results of the Beni and Pando referendums – unlike the comments made after the May 4 referendum in Santa Cruz – provoked much speculation about the popularity of the prefects, or regional governors, with a view towards the upcoming August 10th vote. That grand finale of this series of referendums will be a recall election in which President Morales and all nine of the prefects will be subject to an up-or-down vote.

The Beni prefect, Ernesto Suárez, enjoys more popular support in his region than does the Pando prefect, Leopoldo Fernández, who is in far more danger of being recalled on August 10th. For more on the upcoming elections see here.


By playing the recall election card, the government is trying to hit the autonomy-favoring regions hard and destroy the media luna prefects’ coalition. It will target the most vulnerable prefects. At this time, those look to be in Pando and possibly Tarija, which will hold a referendum on its autonomy statutes just when the recall election campaign is most intense, on June 22. If the June 22 autonomy referendum fails in Tarija – or if the prefect loses the recall vote – it would not only fracture the autonomy movement, but also give the Morales government new influence in the strategic gas-rich region.

Tarija’s Turn

Yesterday the Tarija prefect, Mario Cossio, was in the Beni capital celebrating that region’s yes vote for the autonomy statutes. On that occasion, he assured that Tarija would have little difficulty voting the same way.

The June 22 vote in Tarija will be the last autonomy statute referendum of the four regions that make up the media luna. Cossio asserted that, “Today we are four, tomorrow we will be five, then six and in the end, nine autonomous regions,” clearly alluding to a process in which autonomy is thought to be inevitable by its supporters.

Tarija, however, has a different political panorama than the other three regions of the media luna. On one hand, there is a strong small farmer movement which rejects the autonomy statutes, on the other there is a strong civic movement in the Chaco region which supports autonomy but rejects regional centralism. The Chaco region has a decent amount of weight in Tarija because it is there that the largest gas and petroleum reserves in Bolivia are concentrated.

The Chaco region, without whose support the June 22 referendum could easily fail, has even proposed separating from Tarija and creating a tenth region in the country together with the Chaco areas of the Santa Cruz and Chuquisaca (Sucre) regions. Although the Chaqueños’ demand is not currently moving forward in any way, it is a latent danger for the supporters of autonomy.

Given this situation, the Tarija prefect has seen the political necessity of negotiating with the Chaco authorities and has had to give up important powers to a sub-regional level of government. One of those is the direct election of subprefects, who currently are named specifically by the Tarija prefect.

If Mario Cossio continues to negotiate with the Chaco region leadership and with the small farmer sector, the Tarija autonomy statute could achieve a certain balance in its content and the support of the population would be far less divided than in Beni, Pando, and Santa Cruz.

Thats some pretty heavy spin. In reality there was heavy support for the referendum in Beni and Pando,and the president failed draw enough absenteeism either in the urban areas or in the countryside to make the referendum invalid. Thats with the intimidation. Rada didnt let reality get in the way though. Good man.

Best news of the day: Carlos Sanchez Berzain has been granted political asylum. Gonzalo Sanchez de Lozada to follow, which causes Evo Morales to ruffle his funny haircut and distract him from observing other mens' sizes.

Whatever about Goni, Berzain being granted asylum is a sad day for those who value human rights. Condemned in several international reports from the UN to Amnesty, with overwhelming evidence that he used the army to use excessive force which resulted in the murder of 67 people.

I had the opportunity to meet many of the families of the 67 who died, and have examined some of the cases involved in their deaths - many of which Berzain gave direct orders for. Anon, you should be, but obviously aren't, ashamed in finding joy in the protection of such a character.

Let use be clear that Berzain's political asylum is joke by the name itself, he has been working as a political campaigner for the Republican party, and no doubt that has helped him escape justice.

It is another dark blot on the already bloody pages of United States involvement in Latin American affairs.

While I do not support Goni or Berzain, the news of their asylum is GOOD news for anyone concerned about human rights.

They have absolutely no chance of getting a fair trail, and is further evidence that in Bolivia de Judicial system is corrupt.

Rather than criticize the US for granting a (no-brainer) asylum, you should focus on criticizing Evo for creating such conditions.

I guess, you must have been on the room when Berzain gave the order or had his cellphone tapped. I do not know if he or Goni gave the order. All I know is that laying siege to a city is a WAR crime and these 67 who died were lambs led to the slaughter by the FEJUVE and the like, and they are the true responsible party for this war crime.

Well, I’m happy that the Chaco is finally turning up on the political analysis radar. The region is the key to fracturing the autonomy movement. For a movement whose discourse relies heavily on the mythical idea that all “Cambas” are united around autonomy based on the ideals of the Comité Pro Santa Cruz, the autonomy struggle could be significantly discredited if the MAS government simply gave more voice to its potential allies in the Chaco. The Chaco is the most indigenous area in the lowlands, with about 30% Guaraní population, has a lot of leftist mestizos and whites who are willing to negotiate and support the agenda of the Asamblea del Pueblo Guaraní (the Guaraní local governing body) and sits on top of the vast majority of Bolivia’s most valued natural resource. The biggest enemy of the Chaco is not MAS and the highlands, as Santa Cruz would like to imagine, but the Cívicos themselves.

Most people in the Chaco support Evo’s nationalization of hydrocarbons and his land reform. Many also want some sort of autonomy. As Jim has said in the past, it would have been smart early on for Evo to simply have said, “Okay, people want autonomy? Let’s talk about what kind of autonomy?” Instead of clinging to Bolivia’s historical centralism, which might still be preferable to a Marinkovic/Urenda/Costas-led autonomy, Evo could have changed Bolivian history by allowing a carefully crafted administrative decentralization that would still have increased the power of his supporters (and ultimately himself) and could gain him new ones from the so-far ignored regions of the country.

Now that he has let this time pass, the Chaco stands as one of his only possible avenues for success in this strategy. Chaqueños have proposed several things in the passed, including the first call for a Constituent Assembly, they have voted for autonomy, while electing almost entirely MAS candidates to the Assembly, and have a precarious yet workable relationship with highland organizations in and out of the government. A little respect and visible need for help from the government is all many Chaqueños need to really do some egalitarian damage to the neo-fascist part of the autonomy movement. The rest of the autonomy movement, that to which many campesinos, a few disgruntled indigenous leaders, and working class urban dwellers (who basically amount to the group that gives the autonomy movement legitimate support in international and somewhat domestic yes) ascribe, is not a bad idea.

Autonomy in some form is necessary for Bolivia to overcome its decades of top-down control. However, a scenario in which elite Cruceños can keep the gas money for themselves and for their favorite development projects in the lowlands (a scenario quite evident in Juan Carlos Urenda’s “proposal” Separando la Paja del Trigo) is nothing anyone should fight for.

What, no comments on Morales's fascination on other mens' size?

I consider el Zorro as a corrupt sleazeball (which are a dime a dozen in Bolivia and still are part of its government), but not a "genocidal anti-Morales" corrupt sleazeball, reason why the Bolivian government wants him and Sanchez de Lozada as badly as Morales needs a decent haircut.

This request for extradition is 100% political and ideological, and there is zero chance they would receive a fair trial. That's what the asylum authorities agreed upon, and I agree with them.

In the way Morales uses the sadly abused word "genocidal," I consider him, Quispe, and his minions much more "genocidal" because they conspired and took down a democratically elected government, so spare me the left duct tears.

Speaking of something else, I'm sure you can provide with "no doubt" proof that el Zorro is a Republican operative and that with "no doubt" it influenced the asylum board.

By the way, el Zorro's main defense lawyer is one of Barack Obama's advisers.

I heard it personally from Berzain's old prospective son-in-law (who worked for his law firm) and second-hand from Berzain's first cousin. I admit giving this as proof that he was working with the Republican party in Miami is weak. So if it helps I retract that part of what I said as I simply cannot find a third-party source to back it up. However the presiding judge was a Republican appointee...

I agree that the use of the word "genocidal" was a mistake and does politicize the extradition somewhat. But Berzain's has been implicated explicitly in several independent UN and human rights reports as being directly responsible for these deaths. He left the country of his own free will (with several million of the "gastos reservados" to boot) so it's rich that he would be able to claim immunity. If it really is the human rights you are worried about Anon, why the partisan glee that this would upset people who are well aware of what he did in October 2003.

As for Greg Craig (Berzain's lawyer) being an adviser to the Obama campaign, how is this relevant? I'm sorry Anon, we are not all cartoon Liberals or Conservatives - most of us are well aware that Obama is not some shining light of liberty - and has plenty of flaws. One of Obama's foreign policy advisers is Zbigniew Brzezinski, so hearing he has a lawyer that defended Berzain is not some "GOTCHA" moment you can be smug about - because some of us don't see they world like you do - and are happy to understand that no one side or candidate has the monopoly on truth or moral perfection. In other words, stop trying to cartoonise everything, rendering any debate we might have here pointless. So, without descending to pettiness (while doing just that), Oops yourself, for believing everyone else has as blinkered a world-view as you do.

A quick question for you bowsi, have you EVER met any of the families of those murdered by the maSSist zealots commanded by the Fejuve and directed by Evo?
You know, policemen, military conscripts (some of them not even 18 years old), military ambulance drivers and nurses, military wives, men wearing ties, people wanting to sell gas to Chile, etc, etc; are also human beings in Bolivia that deserve to have the same human rights than those using violence to raise their leader to power.
By the way, I have meet many of those participating in the October marches, throwing rocks and dynamite to police and that later on voted for Evo, to be extremely disappointed at him. One of them is currently in Sucre and is part of the people suing Evo for human rights violations in that city.

you didnt address Morales use of insurgent techniques of blockading cities including roads and trains. Since there is no proof that an order was given to kill 67 people, I would think the simplest answer is that Bolivian police are not given the tools to handle protesters even under Morales administration - look at recent events. How well would the police and army handle another bout of insurgent activity? Probably not much better. Bolivia needs the proper equipment like police better trained in strategies that don't involve guns, police horses and dogs.
Bolivia also needs develop respect for the rule law from the top down, a situation that only getting worse amazingly. Law that everyone has to follow protects the powerless.
We all know that those reports from UN/NGOs can say anything by omitting facts for political reasons there are human rights reports out there condeming evo.

Nice watching video of protesters in front of the embassy in La Paz being paid fichas to participate.

The news is saying that the new police chief is fired for stopping indigenous folks from ransacking the embassy. I guess the lethal forms of crowd control will be limited to Santa Cruz only.

Gee, it would be great to feel as safe as those that bad mouth the US from the safety of..umm..Los Angeles.

Just when you think the Morales government has hit bottom of its level of stupidity, you hear their reaction to the violent march by a bunch of drunk thugs and forced serfs to the US Embassy. After I heard what Morales has to say, I'm convinced that his stupidity is bottomless.

I don't want to hear that this march is from "the people." A small bunch of "union and civic organizers" (ie paid provocateurs) and forced union members gleefully planned chaos and destruction on their way to the embassy. Many poor caseritas in their path had their meager earnings and belongings ransacked by these thugs.

In any country in the world, embassy territory is foreign turf, and no matter the disagreements there might be between an embassy and its host countries, international norms demand the host country to protect the physical integrity of that embassy. Even Cuba protects US' quasi embassy building in Havana when there are large marches protesting against the US.

After the police commander did his job by preventing the thugs to approach the embassy grounds to provoke a potentially more lethal situation, he is rewarded by being sacked by Morales, who complained his "repression" of the drunk thugs.

So, this police commander, who not only most likely saved many embassy staff from bodily harm, might have saved the lives (a dozen Marines were on the roof ready to defend the embassy) of the same drunk thugs who were violently attacking them. Speak of ingratitude!

I, mean, really, how more stupid can the Morales government be? From his provocations to the Peruvian president, to his warning of visas to the EU, and now this, all the while crime, corruption, and unemployment is creeping up.

I've become convinced that Morales' stupidity is bottomless, black, and inescapable. He's Black Hole stupid.

Aaron, I didn't address it because I was making a very limited point about evidence surrounding Barzaín's overzealous use of force. Like another poster here, you assume that because I am upset at Barzaín I am an Evo fan, or if I have met the families of those murdered I have no sympathy for the police killed too. Simply not so, and if it helps then I strongly believe those campesinos who did protest in a violent manner, with weapons, that resulted in injury to police and army (though there are cases where when the army indiscriminately fired in El Alto where violent resistance making violent resistance a more complex issue) were explicitly incorrect. Though I personally believe civil disobedience was appropriate in that October. But lets not debate that here.

The Red Cross report into the violence in El Alto is explicit in it's condemnation of the over-use of force in El Alto, where a young soldier was shot dead by his sergeant for refusing to fire indiscriminately in a neighbourhood not involved in the protests. There is strong evidence that Berzaín explicitly ordered this use of force. He has a case to answer in my opinion. Though I take on-board some of the points made above about the words "Genocide" being used in the case.

As for the UN, Red Cross and Amnesty international being biased... where is the evidence for that? What material or tactical interest do they have in the political process in Bolvia? The Red Cross especially have an impeccable reputation, so I am curious to know how their report would be published as a piece of propaganda.

Sorry, but that is the crux of the case. The MAS has already killed several civilians under the same operating logic that Goni did, so it looks like they want it to have it both ways.

Now, I guess that you were not in La Paz during those days, because (1) that was not CIVIL disobedience, it was closer to armed rebellion and (2) their grievance (no gas for Chile) did not justify their use or violence or laying siege to the city.


Now if you want to ignore this, then feel free. But the main argument for their asylum still stands: They cannot possible get a fair trial. The MAS has even rigged the judge selection and the presiding judge is a MAS partisan who in the past has expressed his belief that they are guilty. The bigger question (and bigger problem) is that Evo has made an alrady corrupt and injust system even more unfair and corrupt. The focus of your advocacy should be for a reform that makes the system suitable for trial.

Anon, I spent an inordinate amount of time on a considered response to your point but it got lost in technical glitches and my own carelessness. However I will battle on...

The crux of the point I'm making is that in my opinion, Berzaín used the army as a tool of repression instead of a means of quelling a civil rebellion. Whether or not that rebellion was correct is another point. For instance, some of the army operations in el Alto, which evidence suggests were micro managed by Berzaín, involved indiscriminately firing into neighborhoods that were not even involved in protests. As I mentioned before, a young army recruit was executed by his sergeant for refusing to fire on uninvolved civilians. So it is about whether the army was used legitimately to quell a rebellion, or as a tool for political repression, or as Berzaín said himself at the time "to teach those people a lesson".

As I've indicated above, there is validity in your point about this. El MAS has flooded the courts with their cronies in a misguided attempt to out-do the corruption that came before them. I doubt they would get a fair trial in Bolivia. Though I find it ironic that the judgment on this matter came from a judiciary that gives the thumbs up to Guantanomo. And yes, I'm upset that a man such as Berzaín has used human rights laws to escape his own responsibilities on that matter. But I take your point, the judiciary in Bolivia is now too politicised by el MAS.

I apologies to the authors here for hijacking this thread to be about Berzaín, but a little more patience please! I was not in Bolivia in 2003 and in honesty knew little about it at the time. I have since forged very close personal ties with people from the Zona Sur who were terrified in October 2003 and I worked with many people from el Alto on the other side of the fence, and while I don't have first hand experience I have some idea of the atmosphere at the time. I think some people have over-estimated the violence of those protests for political purposes and others have underplayed it for the same reasons. However I strongly disagree with you about their grievance being only about gas to Chile. I think you are being intentionally naïve if you do not believe that this was the straw that broke the camel's back. It was a response to crony democracy and over twenty years of neo-liberal policies that left them poorer and the ruling classes richer. It was a protest against the enforced and ideologically and morally bankrupt voodoo economic policies of Jeffrey Sachs and Milton Friedman. Against leaders such as Paz Amora and Banzer who sold state treasures while lining their own pockets and Goni who negotiated secret economic deals that broke their working power and say their average wage reduced in a time of global economic growth. If you believe, as I do, that the governing classes had subverted democracy then as a citizen it is your responsibility to engage in civil disobedience.

That's not to say that's what resulted has benefited Bolivia. It hasn't. It's a huge opportunity wasted, but also purposefully frustrated. Anyhow this is a bit more wide that I wanted to go but I take on board your points about the fair trial and as much as it galls me I agree with you on that.

You want to know why Santa Cruz is going through a crime wave? Santa Cruz, despite now being the largest city in Bolivia, has 4,000 police officers compared to La Paz's 8500. Other studies show an even greater disparity. Does that make sense to you?
